Supreme Court to Hear David Mark’s Appeal on ADC Leadership Crisis April 14

The Supreme Court of Nigeria will hear an appeal on April 14, 2026, filed by David Mark, national chairman of the African Democratic Congress, in Abuja. The case challenges a suit by Nafiu Bala, who disputes Mark’s leadership. Mark seeks a stay of execution on a Court of Appeal ruling delivered on March 12. His legal team argues the decision could disrupt the party’s structure if enforced immediately.


Background of the Legal Dispute

The conflict began after Bala filed a suit at the Federal High Court in Abuja. He challenged Mark’s emergence as national chairman. Bala insisted he never resigned as deputy national chairman. Therefore, he claimed he should assume leadership after the exit of Ralph Nwosu.

Soon after, Bala declared himself chairman. He also asked the court to stop party activities pending judgment.


Appeal and Requests Before the Court

Mark, through his lawyer Realwan Okpanachi, filed appeal number SC/CV/180/2026. He requested the apex court to halt the execution of the appellate court ruling.

In addition, he asked the court to:

  • Restrain Independent National Electoral Commission (INEC) from altering ADC’s leadership structure
  • Maintain the current leadership led by him
  • Stop further proceedings at the Federal High Court

Parallel Court Proceedings Raise Concerns

Interestingly, Emeka Nwite had fixed April 14 for Bala’s suit. However, the lower court may adjourn. This often happens when a higher court handles a related matter.

Legal experts say this step respects judicial hierarchy. It also prevents conflicting rulings.

However, Justice Nwite declined immediate approval. Instead, he directed all parties to respond. This ensured fair hearing before any ruling.

The April 14 hearing will shape ADC’s leadership future. If the Supreme Court grants a stay, Mark remains in control temporarily. Otherwise, the dispute may deepen within the party.
